THESE TERMS OF USE PERTAIN TO AN INDIVIDUAL AND/OR COMPANY'S USAGE AND PARTICIPATION IN THE MICE TRAINING & TECHNOLOGY^TM AFFILIATE PROGRAM.  WE RESERVE THE RIGHT TO EDIT, CHANGE, AND AMEND THESE TERMS AT ANY TIME AND AT OUR DISCRETION.

In terms of this agreement, the names of MICE, MICE Training & Technology and MICE.ORG are used to represent MICE Training & Technology, LLC (the company), and are used interchangeably. The names, MICE, MICE TRAINING & TECHNOLOGY, and MICE.ORG are all trademarks of the company MICE TRAINING & TECHNOLOGY, LLC.

BY PARTICIPATING YOU AGREE TO THE FOLLOWING TERMS:

1. JOINING THE PROGRAM.

(a) You must be at least 18 years old to be considered for the MICE Training & Technology Affiliate Program.

(b) By filling out the affiliate sign-up form you will be making an application to become a MICE affiliate, pending our review of your website or online presence. 

(c) Review is made to any website with a specific URL owned by you (as in: a domain name), or a page managed by you on social networking sites (as in: Facebook, MySpace, and other such sites), a personal home page provided by any ISP or other provider, as well as, any blog you may publish (as in: A WordPress Blog, Yahoo 360, Blogger, Blogspot, and so on); as long as the main site owner allows such advertising and affiliate links to be placed there. MICE accepts no responsibility for loss of privileges for violation of the terms of service or terms of use from any other site you manage or use.  Please check the terms of service with your space provider! 

PLEASE NOTE: MICE Training & Technology, does not wish to be associated with any site that promotes negativity and negative energy. We reserve the right to decline your affiliate membership if you are involved with, promote, advertise, or condone any of the following content or material:

• Hacking for the purposes of breaching security (through any venue, public or private), or hacking and/or defacing websites not owned by you.
• Identity theft or fraud.
• Virus, worm, and malicious code writing, scripting, or promoting.
• The exploitation of women, children, and alternative lifestyles.
• The harassment of women, children, and alternative lifestyles.
• Discrimination, racial hate, religious or sexual bias.
  
• Pornography (While we do not have anything against an adult visiting porn sites, we do not wish for our name to be associated with them.)
• Deceptive Internet and marketing practices.
• Spamming.
• Any activity that is illegal in the United States of America, not otherwise covered.
  
• Any other such practice as MICE Training & Technology deems inappropriate.

(d) Your participation in the program is voluntary and solely for the purpose of:  legally advertising  the MICE.ORG site and products to receive a commission on sales generated by your referrals. This is not to be construed as a contract for employment in any way. 

(e) You must provide MICE Training & Technology with the tax identification information requested below, as well as keep your affiliate profile information up-to-date by providing your current address, active e-mail (remember to whitelist mice.org or you may not get our notices!), and any other required affiliate information. 

(f) You also agree to receive periodic mailings to affiliates regarding the MICE Training & Technology affiliate program or offers from its partners. 

2. REVOCATION OF AFFILIATE STATUS. Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (False claims, misleading hyperlinks)
• Spamming (mass email, mass newsgroup posting, etc...)
• Advertising on sites containing/promoting illegal activities
• Violation of intellectual property rights (copying, pirating, or otherwise "borrowing" MICE material, text, or website code)
• Violating intellectual property rights of others.
• Account inactivity for more than 6 consecutive months
• Any of the conditions from 1(c) that would prevent you from becoming an affiliate.

3. LINKING TO MICE.ORG. You may use graphic and text links both on your website and in e-mails. MICE.ORG may also be advertised "offline" in classified ads, magazines, and newspapers.

(a) You may use the graphics and text provided to you by MICE.ORG, or you may create your own as long as they are appropriate according to the conditions in items 1(c) and 2.

(b) MICE.ORG, MICE Training & Technology,^TM and MICE Training & Technology, LLC retains all rights of ownership and copyrights of any graphics provided for the purposes of affiliate advertising.

(c) MICE.ORG, MICE Training & Technology,^TM and MICE Training & Technology, LLC retains all rights of ownership and copyrights of any text, links, URLs, marketing material, and products provided for the purposes of affiliate advertising. 

(d) When Affiliates are offered resale or re-branding rights to a product, MICE.ORG retains all right of ownership and copyrights of the textual and graphical content of the product as provided for in the licensing agreement of that product.

4. AFFILIATE COMMISSIONS. You will be paid referral fees for every MICE.ORG product purchased with Paypal, credit card, and offline check or money orders as follows:

(a) There are two tiers of Affiliate commissions: Tier One and Tier Two. 

Tier One Affiliate commissions are purchases made through referrals using your personal Affiliate ID.

Tier Two Affiliate commissions are earned from from purchases made through referrals by an Affiliate ID of an affiliate that signed up through your Affiliate ID. In other words, you get paid whenever anyone who signed up under you makes a sale!  

(b) Upon signing up, your account will be credited with an immediate $10.00 as our "Thank You!" for joining.

(c) The referral fee will be 10% of the final purchase price for products and services and 25% of the final purchase price for digital downloads to the Tier One Affiliate.

(d) The referral fee will be 50% of the Tier One Affiliates commission for products and services, and 100% of the Tier One Commission for digital downloads from the Tier Two Affiliate sale.

(e) You are responsible for submitting an IRS W9 Form within 30 days of your acceptance in this program. Failure to comply with this requirement will result in your commissions being withheld until you file the form with us. You may mail the form to: MICE Training & Technology, 10712 Willy Avenue, Algonquin, IL 60102, or fax it to us at: 847-458-4246.

(f) Affiliate commissions will be paid out monthly for qualifying commissions. Qualifying commissions are those sales that have passed the "Money Back" guarantee date. Specifically, 7 days after a digital download, and 30 days after any other purchase.  The minimum commission balance of $25.00 is required for payment. If a referred product was refunded, the membership canceled, or money was reimbursed, MICE.ORG reserves the right to deduct the appropriate commissions from the affiliates account.

EXCLUSION: MICE.ORG does provide a no-nonsense, no questions asked,  and unconditional guarantee. If an affiliate is found to have repeated returns after commission has been paid, we will suspend your account pending a review for termination of our program. We believe that people are genuinely good, but we also want to protect ourselves and our affiliates from those who have chosen to pursue negative energy. 

(g) MICE.ORG will provide numerous sales and affiliate specials throughout the year. It is the affiliates option to offer this special pricing to its referral list. If an affiliate or an affiliate referral purchases a service or product under the Affiliate Pricing Special, no commission is earned on that sale as it is already priced below our profitability point.

(h) MICE.ORG does give a commission when an affiliate makes a MICE.ORG purchase and generates a commission for themselves for regularly priced and sale priced products or services that are not already priced for affiliates.  

(i) MICE.ORG does give commissions when an affiliate makes a purchase and generates a commission for a different affiliate for themselves for regularly priced and sale priced products or services that are not already priced for affiliates.

5. AFFILIATE TRACKING. After signing up for the program you will receive a unique affiliate URL which you will use to advertise our website. When someone clicks through this URL a cookie will be set in their browser with your affiliate ID. Your Affiliate ID and their IP address will also be logged with our system. During that visit to our website or any later visit, when a purchase is made the commission will be given based on the existence of the cookie or a match of the IP address in the database. We have a cookie expiration time limit of 190 days, which is approximately 6 months.

PLEASE NOTE: We are not responsible for subsequent purchases (purchases made after the initial sale) by your referral if the purchaser has deleted his/her cookies and does not use your affiliate link to return to our site.

6. TERMS OF THE AGREEMENT.

(a) These terms will begin upon sign-up and review approval with the affiliate program and will end when either you or MICE.ORG terminates your affiliate status. To terminate your participation, you need only to e-mail us informing us of your decision to leave the Affiliate Program. 

(b) The terms of this agreement may be modified at any time by MICE.ORG. However, this agreement is always available in your Affiliate section of this site and, we will always notify you via e-mail of any changes that may affect your status as an affiliate.

(c) If any modification is unacceptable to you, your only choice is to terminate your affiliate status. Your continuing participation in the program will constitute your acceptance of any change.

7. LIABILITY. MICE.ORG, MICE Training & Technology, and MICE Training & Technology, LLC will not be liable for direct, indirect, or accidental damages, loss of revenue, or commissions due to:

• Affiliate tracking failure
• Loss of database files
• Loss or damages sustained from hackers
• Loss or damages sustained from acts of terrorism or war
  
• Loss of data resulting from a failure of LunarPages server

MICE Training & Technology makes no claim that the operation of MICE.ORG and the Affiliate Program will be error-free.

MICE Training & Technology will not be liable for any interruptions or errors due to LunarPages servers, nor acts of nature.
